Anti Money Laundering

As a regulated estate agency, Maclay Property is fully committed to complying with the Money Laundering Regulations 2017, the Criminal Finances Act 2017, and other relevant legislation. We are supervised by HMRC and legally obliged to carry out anti-money laundering (AML) checks on all clients — including sellers, buyers, landlords, tenants, and any beneficial owners involved in a transaction.

This process is essential for protecting both our clients and the wider property market from financial crime.

What We Need from You

Before we can begin working on your behalf, we are required to verify your identity and address. In some cases, we may also need to request evidence of the source or destination of funds.

Failure to provide this information will mean we are unable to proceed with any sale, purchase, or letting arrangement.

We will require:

  • One proof of identity
  • One proof of address
  • Original or certified copies of documents (requirements may vary depending on individual circumstances)

Acceptable Identity Documents

✔ Proof of Identity (one of the following):

  • Valid passport
  • UK photo driving licence
  • EEA member state identity card

✔ Proof of Address (dated within 3–12 months, depending on the document):

  • Bank or building society statement
  • Utility bill (gas, electricity, water)
  • Council tax bill
  • Tenancy agreement from a recognised source
  • UK mortgage statement
  • HMRC tax notification
  • Letter from DWP confirming benefits
  • Home or motor insurance certificate
  • Solicitor’s letter confirming property purchase
  • NHS medical card or GP registration letter
  • Electoral roll confirmation
  • Police registration certificate

Please note: General correspondence is not acceptable for ID verification.

Additional Requirements for Legal Representatives and Organisations

Acting as an Executor or with Power of Attorney

We will require:

  • Copy of will or grant of probate (or Scottish equivalent)
  • Power of Attorney document
  • ID and address documents for all legal representatives

UK Companies

We will require:

  • Certificate of Incorporation
  • Articles and Memorandum of Association
  • Latest Confirmation Statement
  • ID and address documents for anyone with 25%+ ownership or control

Offshore Companies

In addition to the above:

  • Nominee director declarations and/or power of attorney (if applicable)
  • Certificate of Incumbency (if available)
  • Share certificates showing ultimate beneficial ownership

Trusts

We will require:

  • Trust deed
  • List of trustees and beneficiaries
  • ID and address documents for individuals with 25%+ interest or control
