 Keeping Your Property Legally Compliant

As a landlord in Scotland, it’s essential that your rental property meets all current legal requirements. At Maclay Property, we’re here to help you stay compliant — and give you peace of mind that everything’s taken care of.

The following certifications and safety checks are required:

  • Landlord Registration – All landlords must be registered with the local council where their property is located. Registration lasts for 3 years.
  • Energy Performance Certificate (EPC) – A valid EPC is required before a property can be marketed, and it must be renewed every 10 years.
  • Gas Safety Certificate – If your property has a gas supply, an annual inspection by a Gas Safe registered engineer is legally required.
  • Carbon Monoxide Detectors – CO detectors must be installed in every room with a fixed fuel-burning appliance, such as a boiler or gas fire.
  • Legionella Risk Assessment – Landlords must assess the risk of Legionella bacteria in the water system. This should be reviewed every 2 years, or when the tenancy changes.
  • Electrical Installation Condition Report (EICR) – A full inspection of the electrical system must be carried out by a qualified electrician at least every 5 years.
  • Portable Appliance Testing (PAT) – Any portable electrical appliances provided by the landlord should be tested at least every 2 years.
  • Lead Water Testing – For properties built before 1970, a one-off lead water pipe test is recommended.
